At this time we are accepting applicants with a valid cosmetology or barbering license.
Your Membership will be personal to you and may not be used by or for the benefit of any other person or entity.
You understand and agree that this is not a distribution arrangement. Moreover, your Membership does not create any rights of exclusivity and does not constitute a joint venture or partnership of any form.
Your Membership will not become effective unless and until we have provided you written confirmation of acceptance.
Any orders submitted by you are subject to acceptance by us. We reserve the right, in our sole discretion, to reject all or a portion of your order and/or to limit the quantity and/or types of items in your order.
All returns of any items will be subject to our standard web order return policy listed on the Unwash.com website.
Items must be unopened and returned within thirty (30) days from the date of receipt of product.
All prices for items through the Program are exclusive of any federal, state, local and foreign taxes, duties, tariffs, levies, withholdings and similar assessments and will be charged to you at the time your order is accepted. Except as otherwise expressly provided herein, all orders are subject to our standard terms of sale (as the same may be revised or updated from time to time).
You may not use any of our copyrights, trademarks or service marks for any reason, including, without limitation, to advertise or promote our products or brand (whether in print or electronic media, including, without limitation, the Internet or emails) without our prior written consent.
You may not, directly or indirectly, undertake or permit any of the following: (i) marketing, advertising or distribution of our products by or through any person or entity that is a wholesaler, retailer or reseller, including any e-commerce marketplace (e.g., Amazon or similar); and/or (ii) marketing, advertising or distribution of our products through any other means, including e-commerce, mail order, phone order, catalog, telephone solicitation, television, or radio. Distribution or sale of our products through any other channels outside of your authorized salon location(s) is strictly prohibited.
You also agree to take the following measures, including but not limited to: (i) using best efforts to prevent your consumers from engaging in further distribution or sale of the products, including not selling or delivering any products to any consumer reasonably likely to do so; and/or (ii) limiting sales to any consumer to five (5) pieces of any single SKU of Product or less within any single sales transaction.
Without limiting any other rights or remedies, we, at our own discretion, may immediately terminate your Membership if we believe in our sole discretion that you have violated any of the restrictions set forth and may charge you $100 per piece (unit) of diverted product traceable back to you.
We reserve the right to terminate the Program and/or your Membership at any time upon notice. Upon termination of the Program or your Membership, we will have no obligation to take or fulfill any orders for you.
These terms and conditions are governed by the internal law of the state of California without regard to principles of conflicts of law. The undersigned irrevocably submits to the exclusive jurisdiction of the court of competent jurisdiction sitting in and for the State of California.
